Terms of service

The rules that apply when you use useultramaxusa.com and when you buy from us.

1. Who you are dealing with

useultramaxusa.com is operated by the company named on our About page, trading as Ultramax USA. Using this site means you accept these terms. If you do not accept them, please do not use the site.

2. Eligibility

You must be at least 18, or have the consent of a parent or guardian, to send an order request. You must be able to receive deliveries at the address you give us.

3. Requests are not orders

Product listings on this site are an invitation to treat, not an offer. Adding items to your cart and submitting the request form creates an enquiry. No contract exists, and no money is due, until our team has replied with a written confirmation of stock and a final total, and you have paid through the secure payment link in that confirmation. We may decline or adjust any request — for stock, pricing error, or delivery restriction — and we will always tell you why.

4. Pricing

Prices shown are in USD and exclude shipping and any import duty or tax. The complete amount payable — goods, shipping and taxes, itemised — is stated in your order confirmation before you pay anything. Prices on the site can change without notice, but the price in a confirmation we have sent you is held for 72 hours. If a price is listed in obvious error we will contact you rather than silently cancel.

5. Availability

Listing a product is not a guarantee it is in stock in every size and colour. Stock is confirmed per line in your order confirmation. Where a line is unavailable we offer an alternative or remove it — we never substitute without asking.

6. Delivery and risk

Delivery times in our shipping policy are estimates that start from dispatch, not from your request. Risk passes to you on delivery. Title passes on full payment.

7. Returns, refunds and cancellation

Your rights are set out in our returns policy and refund policy, which form part of these terms. Nothing in these terms limits the statutory rights of a consumer.

8. Product information

We describe our products as accurately as we can, and we correct errors when we find them. Colours vary between screens. Measurements are nominal and may vary within normal manufacturing tolerance. Our products are consumer footwear, apparel and gear; they are not medical devices, and nothing on this site is medical advice.

9. Acceptable use

Do not use this site to break the law, to scrape it at a rate that degrades it for others, to introduce malicious code, or to impersonate anyone. We may restrict access to anyone who does.

10. Intellectual property

The Ultramax USA name, the site design, the product photography and the text on these pages belong to us or to our licensors. You may not reproduce them commercially without written permission. Product names that are trademarks of other companies remain the property of their owners.

11. Liability

We are responsible for loss you suffer that is a foreseeable result of us breaking these terms or failing to use reasonable care. We are not liable for loss of profit, loss of business, or indirect or consequential loss. Nothing here excludes liability for death or personal injury caused by our negligence, for fraud, or for anything that cannot lawfully be excluded. Where liability is capped, it is capped at the amount you paid for the order concerned.

12. Third-party links

Where we link out, we do not control the destination and we are not responsible for its content or its privacy practices.

13. Changes and severability

We may update these terms; the version that applies to your order is the one published when your confirmation was issued. If any clause is found unenforceable, the rest stands.

14. Governing law

These terms are governed by the laws of the jurisdiction in which the operating company named on our About page is registered, and the courts of that jurisdiction have non-exclusive jurisdiction. This does not remove the protection of the mandatory consumer law of your country of residence.
